What the KCPA Means for Legal Kratom in Colorado

If you buy kratom in Colorado, there are some important upcoming legal changes that you should be aware of. Kratom is still going to be available throughout the state, but legislators have mandated sweeping standards that will determine what kinds of kratom can and cannot be sold in the Colorado market. The news is all good. 

What Is Happening with Kratom in Colorado

Earlier this year, a bill to regulate kratom products was brought before the Colorado Senate Finance Committee. Senate Bill 22-120 sought to establish the Kratom Consumer Protection Act (KCPA), a set of wide-reaching regulations that would impose safety and quality standards on all kratom products sold in the state. The KCPA was drawn up by the American Kratom Association in 2019 and has already been passed in states like Utah, Nevada, Oklahoma, and Georgia. 

After considerable deliberation, state legislators passed the KCPA with bipartisan support on May 26th, 2022. It’s now set to take effect on July 1st, 2023. When it does take effect: 

  • All kratom vendors will have to register with the Colorado Department of Revenue 
  • Kratom sales will be limited to adults over the age of 21
  • Kratom vendors will have to disclose information related to ingredients and any adverse effects
  • Kratom vendors will be forbidden from using foreign adulterants and synthetic ingredients in kratom products 
  • Kratom products will require a certificate of analysis confirming that they meet state standards based on third-party lab results 
  • Kratom extracts must be made with food-grade solvents and may not contain residual solvents in amounts exceeding federal guidelines 

This move is good news for kratom in Colorado because it greatly reduces the likelihood of dangerous or poor-quality kratom products flooding the market.

Is Kratom Legal in Colorado Right Now? 

Kratom is legal in Colorado right now, albeit with some minor exceptions. In Denver, for instance, kratom is prohibited from being sold for human consumption. As a result, many vendors label their products “Not for Human Consumption.” In addition, the cities of Parker and Monument have banned kratom sales—though possession is still allowed.

Now that there’s a state-wide legal framework for handling kratom, the hope is that these citywide restrictions will be lifted and that others will be prevented.
